Abstract

 

This article examines the current challenges and prospects for the development of the institution of mediation in Kazakhstan as an effective tool for resolving conflicts in contemporary society. The analysis highlights the advantages of mediation, including reduced burden on the judicial system, active participation of the parties in decision-making, confidentiality, process flexibility, relationship preservation, and cost efficiency. Despite its positive aspects, mediation faces several challenges, such as a lack of trust among citizens, low public awareness, difficulties in regulation and training qualified mediators, limited application in political and interethnic conflicts, and the absence of state financial support. The article proposes a comprehensive set of measures for the successful development of the mediation institution in Kazakhstan. These include increasing public awareness, establishing a national school for mediators, state support and regulation, integrating mediation into the judicial system and local governance, developing digital platforms for mediation, and encouraging the private sector and NGOs to utilize it.
