Abstract
The article presents theoretical information about the concept of the "institute of the president", the analogue of which is the "institute of the president", often used in legal science. Both concepts are close to the constitutional and legal meaning. "The interpretation of the "institute of the President" is aimed at harmonizing the activities of public authorities as an integrative legal institution. It is emphasized that the institution of the presidency in Kazakhstan makes a great contribution to the formation of a social state in our country.
European jurisprudence describes the meaning of the term social state, known as the "welfare state". Scientific research of the chosen term has been reflected since ancient times in the works of Plato and Aristotle, the evolution of the Middle Ages and the Enlightenment, the Soviet era and modernity. The main attention is paid to the results of research by foreign authors, including the description of the phased formation of the functions and principles of the welfare state in the scientific works of D. Garland and Mehmet Atilla Guler, first of all, the achievement of protecting the rights of citizens, providing social assistance to those in need. It is often said that the functions of the welfare state cause negative problems, including moral risks, excessive bureaucracy, rising costs and the inflexibility of the labor market.
